§ 14 Time limits for utilizing area allocations
14.1 The deadline for the utilisation of a land allocation for construction that requires a building permit is 2 years. An application for a building permit must be submitted no later than 1 year after the land allocation has been issued. An application for occupancy must be submitted within 2 years of the land allocation, cf. planning and land use legislation (Section 47). In the case of major construction or civil engineering projects, the Municipal Council may extend the deadline for the utilisation of the land allocation for the area in question for 1 year at a time (Section 46).
14.2 The deadline for utilizing an area allocation that does not require a building permit (for example, storage areas, enclosures, playhouses, etc.) is 1 year.
14.3 An unused area allocation shall lapse without further notice if the deadline set in the area allocation has been exceeded. If the Municipal Council has agreed to an extended deadline for utilization of the area allocation, cf. paragraph 14.1 above, the right of use to the area in question may only lapse if the licensee has not complied with an order to bring the area into use.
14.4 If a deadline is exceeded in an utilized land allocation, the Municipal Council will initiate steps to rectify the situation, in accordance with planning and land legislation.
14.5 The Municipal Council may extend the deadlines set out in paragraphs 14.1 and 14.2 in special cases where it is deemed that the land allocation holder can complete the project and will comply with the stipulated terms of the land allocation, if a written, reasoned application to this effect is submitted before the expiry of the deadline for which an extension is sought, with a documented time and activity plan.
14.6 The Municipal Council may also extend the deadlines set out in paragraphs 14.1 and 14.2 in connection with large construction projects and technical installations where design and construction cannot be completed within 2 years with a documented time and activity plan.
