Publication and Hearing of Land Applications

Residences

  1. Ongoing Publication:
    • The land use authority must regularly publish which areas in the municipality's towns and settlements can be expected to be allocated areas in accordance with the municipality's planning, including the main structure's plan for the inclusion of new sub-areas during development.
  2. Publication of Applications:
    • Before a final decision is made on land allocation in cities and towns, the Municipal Council must publish the application for land allocation.
    • Publication may be omitted if the application is in accordance with the applicable detailed local plan provisions for the sub-area.
    • Publication may also be omitted if the area, buildings, facilities or other land use are minor or of minor importance, including changed land use or transfer of rights of use in connection with the sale of buildings.
  3. Deadline for Objections:
    • In connection with the publication of an application, the planning authority must set a deadline of at least 14 days to submit objections to the application.
    • If objections are raised against an application, the zoning authority must include the objections in its consideration of the application.

Open Country

  1. Publication and Consultation:
    • Before an area allocation in the open countryside can be announced, the Municipal Council must publish the application and send it for consultation with affected authorities and any parties.
    • The consultation of authorities may be omitted if the authorities concerned agree not to be consulted.
  2. Deadline for Comments and Objections:
    • Authorities, parties and others may submit comments or objections within a period set by the Municipal Council. The period must be at least 3 weeks after the publication or receipt of the application.
  3. Exceptions from Publication and Consultation:
    • Publication and consultation may be omitted if the matter concerns a transfer of the right of use or smaller installations, including small extensions to existing cabins.

This structure ensures a transparent and democratic process for land management in Greenland, where all affected parties have the opportunity to be heard and involved in the decision-making process.
